If you read the document, you will see that Blingville is asking the court to show that they are not infringing any trademark, which is what Zynga claimed in Zynga's letter. Point 15 in "Factual Background" shows that Zynga sent Blingville the letter originally. Blingville is just hitting back.

I find it (the feed being spammed) + the fact i was contacted by two people involved in the site (one pr, one 3rd party supplier) and eircom themselves via twitter because of my opinion on the service, kinda creepy and overzealous in pushing musichub.

Eircom should have used the same system as downloadmusic.ie. All you need is a mobile phone to buy the music.

Granted it has no streaming, aside from a 30 second preview, but musichub with that concept for selling music would be unbeatable for ease of use and buying.

As for Grooveshark, I feel the same about your comment on it as I do regarding what a third party supplier for eircom said to me on Twitter today. He was saying that Grooveshark is a legal grey area. So what? Things being in a grey area does not mean they are illegal (for now ;) ) and they can still be used.

As for dismissing it as a fail after a day, are you going after all those connected to Eircom who are saying it's a win? How long are we to hold off our opinion of something?

If streaming, even for half the song, was introduced with no need to pay or be on eircom and they sorted mobile/flash problems I would certainly give them bonus points, but until then, it isnt for me and it isn't for the four members of the site I asked while writing the above piece.

And the article is not just about the music site, it's about the boards forum (which I have doubts about) and their comment of filesharing. So yes, technically you are right it's about a dislike of Eircom, but the start, that's entirely about the dislike of their music store.

We can agree to disagree if you wish :)

i dont like lastfm or shoutcast but looked at grooveshark and really like it. bookmarked n all!
youtube is ok, good selection there. ads are headwreckin though! not allot of selection either
the download prices are ok on eircom but the streamin for money thing is crap. ill listen to music on grooveshark first before i bother signing up and buyin!

YouTube doesn't have playlists (yet), Grooveshark is probably going to get shut down if it doesn't sort out some rights deals (which if the likes of Spotify are anything to go by, will mean a retrenchment of geographies), LastFM doesn't give full streams and Shoutcast is apples v oranges. Personally, I think dismissing a day-old beta as a fail says more about dislike of eircom than anything to do with musichub. I'm not on eircom but if they increase the catalogue I could see a value in it, especially if they ever come out with a mobile version, and the download charges are pretty decent, certainly better than anything else I've seen in Ireland.
